1. Acceptance of Terms

By accessing or using CodeSpeedTest (the "Service"), you confirm that you are at least 16 years of age, have read and understood these Terms, and agree to be legally bound by them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

These Terms constitute the entire agreement between you and CodeSpeedTest regarding your use of the Service and supersede all prior agreements relating to the same subject matter.

2. About the Service

CodeSpeedTest is operated by Saurav Khanal ("operator", "we", "us", "our"). The Service is accessible via https://codespeedtest.com and any future mirrors or subdomains we may operate.

CodeSpeedTest provides a coding speed and accuracy practice platform that allows developers to:

Practice typing real code in 500+ programming languages
Measure their words per minute (WPM) and accuracy
Track progress through analytics and session history
Earn verifiable certificates for demonstrated typing proficiency
Compete on a public leaderboard
Upgrade to a Pro subscription for premium features

3. Permitted Use

You may use the Service for lawful personal or educational purposes. When using CodeSpeedTest, you agree not to:

Use the Service for any unlawful purpose or in violation of applicable laws or regulations
Attempt to gain unauthorized access to any part of the Service or its infrastructure
Use automated scripts, bots, or scrapers to access or extract content beyond fair use
Impersonate any person, entity, or organization
Upload or transmit malicious code, viruses, or any disruptive content
Interfere with the normal operation of the Service or servers
Attempt to circumvent any security measures, access controls, or authentication
Harvest or collect personal information about other users without consent
Use the Service to send unsolicited commercial messages (spam)

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these provisions, including without limitation, reporting violations to law enforcement authorities.

4. User Accounts

To access certain features of the Service, you may register for an account. When creating an account, you agree to:

Maintain and promptly update your account information

5. Pro Subscription and Payments

CodeSpeedTest offers a Pro subscription plan with additional features. By subscribing to the Pro plan, you agree to the following:

You authorize us to charge your payment method on a recurring monthly basis
Payments are processed securely through Stripe — we do not store your payment card details
Subscriptions automatically renew unless cancelled prior to the renewal date
You may cancel your subscription at any time through the billing portal
Upon cancellation, Pro access continues until the end of the current billing period
We do not offer refunds for partial billing periods unless required by applicable law
Pricing may be changed with reasonable notice to subscribers

6. Intellectual Property

The Service and its original content, features, and functionality are owned by CodeSpeedTest and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Specifically:

The CodeSpeedTest name, logo, and branding are our trademarks
The platform's design, user interface, and original code are our copyrighted works
Code samples used for practice purposes are used under open-source licenses or as educational fair use
Certificates issued by CodeSpeedTest remain our intellectual property; your right to display them is non-exclusive and non-transferable

You retain all rights to any content you submit to the Service, but grant us a non-exclusive, royalty-free, worldwide license to use, store, and display such content for the purpose of providing the Service.

7. Certificates

CodeSpeedTest issues verifiable certificates upon achieving qualifying WPM and accuracy thresholds during timed tests. Regarding certificates:

Certificates reflect performance at the time of the test and are not guarantees of future performance
We reserve the right to invalidate certificates obtained through cheating, automation, or misuse
Certificate download (PDF) is a Pro feature; the shareable link is available to all users
We may update certificate design and branding; existing certificates remain valid

8. Advertising and Third-Party Services

The Service displays advertisements served by third-party ad networks, including Google AdSense and Adsterra. By using the Service, you acknowledge that:

Third-party advertisers may use cookies and similar technologies to serve relevant ads
We are not responsible for the content, accuracy, or practices of third-party advertisers
Clicking on ads may take you to third-party websites governed by their own terms and privacy policies
You can opt out of personalized advertising through Google Ads Settings

We also use third-party services for authentication (Supabase), payment processing (Stripe), and email. Each of these services is subject to its own terms and privacy policy.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

We do not warrant that:

The Service will be uninterrupted, error-free, or secure at all times
Results obtained from using the Service will be accurate or reliable
Any errors in the Service will be corrected
The Service or its servers are free of viruses or harmful components

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CODESPEEDTEST, ITS OPERATOR, AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your access to or use of (or inability to access or use) the Service
Any conduct or content of any third party on the Service
Any content obtained from the Service
Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim, or $10 USD, whichever is greater.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

Your right to use the Service will immediately cease
Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability
Any active Pro subscription will be cancelled at the end of the current billing period

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be subject to binding arbitration or the jurisdiction of courts in the operator's country of residence.

13. Changes to Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will:

Update the "Last Updated" date at the top of this page
Display a notice on the website for significant changes
Notify Pro subscribers via email for changes affecting their subscription

Your continued use of the Service after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service.
